Terms and Conditions

These Terms govern access to and use of Rectru, an AI-assisted hiring and candidate evaluation platform operated by Mendzys Inc.

These Terms are published in English, which is Rectru’s primary operating language. If a translated version is provided in the future, the English version will control to the extent permitted by law.

1. The service

Rectru provides software and related services to support interview workflows, candidate communications, recordings, AI-assisted evaluations, candidate management, and related recruitment operations.

Rectru is provided as a tool to support recruitment workflows. It does not guarantee hiring outcomes, workforce performance, legal compliance decisions, or the suitability of any candidate.

2. Customer account and use

Customers are responsible for:

  • maintaining the confidentiality of account credentials;
  • restricting access to authorised users;
  • ensuring all use of Rectru under their account is lawful and authorised;
  • configuring and using Rectru in accordance with applicable employment, privacy, and anti-discrimination laws.

3. Acceptable use

Customers must not:

  • use Rectru for unlawful, discriminatory, or abusive purposes;
  • upload or submit content without proper authority;
  • attempt to gain unauthorised access to the service or related systems;
  • interfere with the integrity or performance of the platform;
  • use Rectru to make unlawful solely automated employment decisions where prohibited by applicable law;
  • use Rectru to spam, harass, or unlawfully surveil people.

4. AI-assisted functionality

Rectru may generate automated questions, summaries, evaluations, recommendations, and related AI-assisted outputs.

Such outputs may be incomplete, inaccurate, or unsuitable in a specific case. Customers are solely responsible for reviewing and validating outputs before relying on them.

Rectru is intended as a decision-support platform and not as a substitute for independent human judgment, legal review, or professional employment advice.

5. Customer content

Customers remain responsible for the content they and their users submit to Rectru, including candidate materials, interview configurations, communications, and records.

Customers represent that they have all necessary rights, notices, permissions, and lawful bases to use that content with Rectru.

6. Data protection

Data protection obligations are governed by applicable law, this website’s Privacy Policy, and any applicable contract or Data Processing Addendum.

For customer recruitment data processed through Rectru, the customer is generally the controller and Mendzys Inc. is generally the processor.

If the customer uses Rectru to process personal data on behalf of third parties, Rectru’s Data Processing Addendum is incorporated into and forms part of these Terms where applicable.

7. Security and availability

Mendzys Inc. uses reasonable measures designed to support service security and availability. However, Rectru is provided on an “as available” basis, and uninterrupted or error-free operation is not guaranteed.

8. Fees and billing

Where applicable, customers agree to pay fees in accordance with the applicable order form, plan, or subscription terms. Mendzys Inc. may suspend or limit service for non-payment, subject to applicable law and agreed commercial terms.

9. Intellectual property

Rectru, including its software, workflows, interfaces, branding, trademarks, and related materials, is owned by or licensed to Mendzys Inc.

Except for limited rights expressly granted to use the service, no ownership rights are transferred to customers.

10. Feedback

If a customer provides suggestions, ideas, or feedback relating to Rectru, Mendzys Inc. may use that feedback without restriction or compensation, provided this does not grant rights to the customer’s confidential information beyond what is necessary to use the feedback.

11. Suspension and termination

Mendzys Inc. may suspend or terminate access where reasonably necessary to:

  • protect the security or integrity of the service;
  • address unlawful use;
  • prevent harm to users, data subjects, or third parties;
  • comply with law or binding orders;
  • address material breach of these Terms.

12. Disclaimer

Rectru does not provide legal advice, HR advice, employment advice, or other regulated professional advice. Customers are responsible for their own compliance with employment, privacy, anti-discrimination, accessibility, and AI-related laws and regulations.

13. Limitation of liability

To the maximum extent permitted by law, Mendzys Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, or data arising from or related to the service or these Terms.

To the maximum extent permitted by law, Mendzys Inc.’s aggregate liability under these Terms will not exceed the amounts paid or payable by the customer for the service during the 12 months preceding the event giving rise to the claim.

14. Indemnity

Customers will indemnify and hold harmless Mendzys Inc. from claims arising out of unlawful use of Rectru, customer content, or violation of applicable law or these Terms by the customer.

15. Governing law

These Terms are governed by the laws of the State of Delaware, unless otherwise required by mandatory law or otherwise agreed in writing.

16. Changes to these Terms

Mendzys Inc. may update these Terms from time to time. Updated Terms become effective when posted or otherwise communicated, unless a later effective date is stated.
